DISCLAIMER and RELEASE 2010
This Disclaimer and Release is by and between the ORINDA ARTS COUNCIL, a volunteer charitable organization (Hereinafter “Sponsor”) and the student listed on this form (Hereinafter “Artist”). Sponsor is sponsoring a display of student artists’ work (the “Exhibition”) at the Orinda Library Art Gallery (the “Library”). The Library is owned by the City of Orinda and Sponsor does not control access to the Library, nor is the Sponsor responsible for maintenance of the Library or for providing security at the Library. Artist desires to exhibit artwork at the Library as part of Sponsor’s Exhibition. Sponsor is not willing to accept the Art for display as part of the Exhibit unless Artist (by a parent or legal guardian if not 18 years of age) agrees to release Sponsor from any and all claims for loss of the Art or damage which it may suffer by reason of Sponsor’s acceptance of the Art for display at the Exhibit. As consideration for Sponsor’s acceptance of the Art for display in the Exhibition, Artist hereby assumes all risk of damage to the Art while on display at the Exhibition arising from any cause whatsoever and Artist hereby waives all claims in respect thereof against Sponsor. Artist hereby agrees that Sponsor shall not be liable to Artist for injury or damage to the Art or any loss of value thereof or for damage thereto while the Art is on display at the Exhibition or otherwise in the care or custody of the Sponsor or otherwise, not withstanding the cause of said damage or loss, which case may include but not be limited to such causes as fire, steam, electricity, gas, water or rain, or the breakage, leakage, obstruction or other defect of pipes, sprinklers, wires, appliances, plumbing, air conditioning or lighting fixtures, any conditions arising upon the Library, or from other sources or places. Sponsor shall not be liable for any damage to the Art arising from any act or neglect of any other Artist, any person attending the exhibition, theft, defacing or otherwise by any person.
NOTE: Because the Art Exhibition will be held in a public space, it is necessary for artists to sign a Release Form. Much of the displayed art will be securely attached to wall systems. Small and fragile articles such as jewelry will be displayed in locked glass cases.
The Orinda Library Art Gallery cabinet and wall dimensions are posted on
http://www.orindaartscouncil.org/artscom.html under Arts in the Community. There are two different hanger systems both of which require wall art to be framed and have a wire spanning the entire width of the back side of the frame. The wiring should be secure and not visible from the front when hung. Artists must have frames wired before delivery to the Gallery. Three dimensional art must fit inside cabinet shelves. Failure to adhere to these guidelines may disqualify students from competition.
